Website Terms of Service
These Terms of Service ("Terms") govern your access to and use of the White Label Loyalty websites and related services (collectively, the "Services"). By using the Services, or otherwise indicating acceptance, you agree to these Terms on behalf of the business entity you represent. If you do not agree, do not use the Services.
These Terms are entered into by and between Perks Loyalty Ltd ("White Label Loyalty", "we", "us", or "our") and the customer identified in the enquiry form or other Services interface ("Customer", "you", or "your").
Business users only. The Services are offered solely for business use. If you are a consumer, do not use the Services.
1. Account & Eligibility
1.1 Authority. You represent that you have authority to bind the Customer to these Terms.
1.2 Account Security. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized use.
2. Description of Services
We provide a website and related services designed to promote the products and services offered by Perks Loyalty Ltd to prospective customers. These associated services may include collecting and processing contact details submitted through enquiry forms and following up via email, telephone, or other communication channels to facilitate discussions regarding a potential business relationship.
3. Your Responsibilities
3.1 Lawful Use. You will use the Services only in accordance with these Terms and applicable law.
3.2 Data Accuracy. You are responsible for the accuracy, quality, and legality of all data you submit to the Services, including phone numbers and contact preferences.
4. Communications: Sales Calls, SMS, and Recording (AI or Human)
4.1 Consent to Receive Calls/SMS from White Label Loyalty. By providing a phone number and submitting your details on our website or related forms, you consent to be contacted by White Label Loyalty by phone and/or SMS for sales and service follow‑up. Contact may be made by a human sales representative or by an AI‑assisted agent/automated system acting on our behalf. We will contact you for the purposes stated at the point of collection (e.g., responding to your enquiry, providing information about our products and services, or arranging a demo). You can withdraw consent at any time.
4.2 How We Conduct Calls and SMS. During any call or message, we will:
- clearly identify White Label Loyalty as the caller/sender at the start;
- provide an easy opt‑out mechanism (e.g., reply STOP to end SMS; tell the caller you do not wish to be contacted, or follow IVR prompts if present);
- promptly honour opt‑outs and maintain suppression lists; and
- schedule outreach in line with applicable laws and quiet‑hour rules in each jurisdiction.
4.3 Message Frequency & Charges. Message and data rates may apply. Frequency varies based on your interactions and preferences.

Opt‑out: reply STOP to SMS or inform the caller you do not wish to receive further calls.
4.4 Call Recording (If Enabled). Where call recording is enabled, we will provide required pre‑call and in‑call notices and obtain consent where legally required. Please avoid sharing sensitive information during calls unless necessary and permitted by law.
5. Customer Data & Privacy
5.1 Definitions. "Customer Data" means data you submit to the Services, including personal data of your leads, customers, and users.
5.2 Ownership. As between the parties, you own all right, title, and interest in Customer Data. You grant us a non‑exclusive license to process Customer Data to provide and improve the Services, including security, analytics, service optimization, and AI model quality assurance (subject to Section 5.4).
5.3 Privacy Policy & DPA. Our processing of personal data is described in our Privacy Policy. Where required, a Data Processing Addendum (DPA) forms part of these Terms.
5.4 AI Features. Certain features may leverage AI models to generate content or analyze interactions. You are responsible for reviewing outputs. You must not use AI features to process special category data unless you have a lawful basis and appropriate safeguards. You agree that we may use de‑identified data to improve model performance and safety.
6. Third‑Party Services
The Services may interoperate with third‑party services (e.g., telephony providers). Your use of third‑party services is subject to their terms and policies. We are not responsible for third‑party services.
7. Intellectual Property
We and our licensors retain all rights to the Services, including software, documentation, and trademarks. No rights are granted except as expressly stated.
8. Warranties & Disclaimers
8.1 Mutual Warranties. Each party represents that it has the authority to enter into these Terms and will comply with applicable laws in performing hereunder.
8.2 Disclaimer. Except as expressly stated, the Services are provided “as is” without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the Services will be uninterrupted, error‑free, or that outputs will meet your requirements.
9. Limitation of Liability
To the fullest extent permitted by law: (a) neither party is liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits, revenues, goodwill, or data; and (b) each party’s aggregate liability arising out of or related to these Terms will not exceed the amounts paid or payable by you to us for the Services giving rise to the claim in the 12 months prior to the event giving rise to liability. Nothing limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.
10. Indemnity
You will indemnify and hold us harmless from any third‑party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Services in violation of these Terms or law.
11. Changes to the Services or Terms
We may update features or these Terms from time to time. If we make material changes, we will provide notice by posting the revised Terms with a new "Last updated" date. Your continued use after the effective date constitutes acceptance.
12. Governing Law; Venue
These Terms and any non‑contractual obligations arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England shall have exclusive jurisdiction.
13. Export & Anti‑Corruption
You will comply with all applicable export control and anti‑bribery laws. You represent that neither you nor your beneficial owners are subject to sanctions.
14. Notices
Notices to White Label Loyalty must be sent to the contact details on our website. Notices to you may be provided via the Services or the email associated with your account.
15. Order of Precedence
If there is a conflict between these Terms and any other agreements between You and Perks Loyalty Ltd, the order of precedence is: (1) Any other agreements, (2) these Terms.
